By accessing or using PhishPlease's phishing simulation and security awareness training platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

PhishPlease provides a platform for organizations to conduct phishing simulations, security awareness training, and related analytics to improve their cybersecurity posture. The Service includes email, SMS, and voice phishing simulations, employee training modules, and reporting dashboards.

3. Authorized Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically:

• You must have authorization to conduct phishing simulations within your organization
• You may only target employees of your own organization or those who have consented
• You must not use the Service to conduct unauthorized or malicious phishing attacks
• You must comply with all applicable laws and regulations

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection laws and your organization's privacy policies.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by PhishPlease and are protected by international copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

PhishPlease shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

8. Service Guarantee

If your organization experiences a successful real phishing attack while actively using our platform with proper implementation, we will refund your last three months of service fees. This guarantee is subject to verification and our reasonable determination of proper platform usage.

9. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may cancel your subscription at any time. Upon termination, your right to use the Service will cease immediately.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
